Abstract EN

Criminal protection of human rights is one of the positive aspects embodied in the contemporary international law; it is the linking point between previous human rights infringements and future expectations of human protection.

Research embodies three parts, the first one deals with opinions opposing the establishment of international criminal court which also consists of three parts, the first one deals with the conflict of establishment of International Criminal Court with the principle of sovereignty of states; the second part deals with its conflict with principle of regionalism of criminal law while the third sets forth that establishment of the court conflicts with the principle of nonintervention.

The second part of the research deals with voices supporting the establishment of the international criminal court in four sections; the first three of which refute the aforementioned opposing voices, while in the fourth, the researcher sets forth the reasons behind the establishment of international criminal court.

The third part of the research deals with establishment of international criminal court to fight human rights violations.

This part consists of four sections, the first one sheds light on International Criminal Court Statute, the second deals with the nature of International Criminal Court, the third deals with USA and International Criminal Court while the fourth deals with the possibility of International Criminal Court's replacement of collective punishments.

In its epilogue, the research sets forth a future perspective of the International Criminal Court establishment.

The research argues that if articles of association were set properly, and there was a good intention to implement them, the International Criminal Court would be a substitute for international collective punishments.
