Abstract EN

This paper deals with the electronic check as one of the outcomes of the information revolution in payments.

It can be used as a substitute for the paper check, and can be edited and transmitted electronically.

Such means is easier and less expensive for both the drawer and the drawee.

It allows banks to process payments faster and more efficiently.

Moreover, it is an electronic instrument that equates fully to paper checks and abides by the same laws or regulations that govern paper checks.

On the other hand, a considerable number of legal uncertainties have been raised about the extent of systemic processing, requirements, and obstacles facing electronic checks.

This, actually, is the focus of the research.

The research, thus, includes two parts; the first one addresses the legal system of electronic checks while the second scrutinizes their validity and authenticity.

Finally, the study ends with a conclusion and recommendations that support the spread of such system and provide confidence and authenticity to the e-checks.
