Abstract EN

This research aims to identify the rights of the mortgagor pursuant to the Saudi mortgage law.

The study adopts the analytical and comparative approach.

It falls into two parts.

First, the mortgagor’s right to sell the mortgaged property.

Second, The right of mortgagor to use the mortgaged property.

It thus concluded that mortgage does not debar the mortgagor of his right to sell the mortgaged property.

The study also concluded that the property shall remain in the possession of the mortgagor who shall have the full right to sell or use the property, provided that the debtor or mortgagee is not affected by such rights.
