توعد العدالة الانتقالية ضرورة لازمة لإعادة تأسيس الدولة على أسس شرعية قانونية و تعددية ديمقراطية، لأن السير نحو المستقبل يقتضي تصفية شاملة و نهائية لكل نزاعات الماضي، و هذا يتم عن طريق الأخذ بمفهوم العدالة الانتقالية بعدها السبيل الذي يضمن تحقيق العدالة و الأنصاف للضحايا، و الانتقال من ماض مؤلم إلى مستقبل مشرق.
إن العدالة الانتقالية تعني تحقيق مبدأ العدالة في إثناء الانتقال من نظام استبدادي إلى نظام ديمقراطي، أو من حرب أهلية إلى سلم، أو التحرر من الاحتلال، كما أنها تشمل العمليات و الآليات المرتبطة بالمحاولات التي يبذلها المجتمع لتفهم تركته من تجاوزات الماضي الواسعة النطاق بغية كفالة المساءلة و إقامة العدالة، و قد تشمل هذه الآليات القضائية و غير القضائية و عن طريق دراسة تجربة العدالة الانتقالية في جنوب إفريقيا نستطيع أن نستنج ما يلي : إن مستقبل العدالة الانتقالية واجه عدة تحديات، في دولة جنوب إفريقيا، و نجاحها كان مرهون بالتحديات السياسية التي تتمثل بالحكم الذاتي، بإقامة دولة لقبيلة الزولو، و اتخاذ القرارات بالأغلبية.
و تحديات اقتصادية تمثلت بإمكانية توزيع الثروة، و قضايا الفساد، و البطالة.
و تحديات اجتماعية تتمثل بالمجال الثقافي و التعليمي، و في المجال الصحي، و في مجال الإسكان، و ارتفاع معدلات الجريمة.
الا أن كل ذلك تم تجاوزه و ترسيخ سياسة التعايش السلمي التي انعكست على استقرار النظام السياسي و نجاح تجربته في العدالة الانتقالي.
