English Abstract

This study deals with a significant issue theoretically and practically; it determines the extent of whether the judge is allowed to apply The International Trade Law rules directly without a means, and what the basis of such practice is.

Therefore, firstly, this study has discussed what the rules of The International Trade Law are.

Secondly, it has looked for at the sources of The International Trade Law to find out, the extent to which these rules are binding and the legal basis of such an obligation; thus, all these sources constitute as “a single unit” the so-called The International Trade Law.

Thirdly, this study has shown the basis of the practice of The International Trade Law on the dispute before the national judge.

Furthermore, the study has discussed the extent of whether The International Trade Law Rules are forming a legal system or not.

This study has concluded that the legal basis of The International Trade Law is direct practice; however, and due to the limitations in such a direct application of The International Trade Law Rules, another basis is needed, it is the Conflict Methodology or what is called (The Conflict of Law Rules).
