Arabic Abstract

• تناقش هذه الرسـالة موضـوع تقييـد انتقـال أثـار العقـد إلـى خلـف المتعاقدين سـواء أكـان هـذا الخلـف عامـا أم خاصـا، حيـث يعتبـر هـذا الموضوع من الأهمية بمكان نظرا للأثر الذي يرتبـه علـى الـذمم الماليـة لكـل من الخلف العام و الخلف الخاص، فنرى أن أعـداد القـضايا التـي تتعلـق بهـذا الموضوع تتزايد كل يوم أمام القضاء الأردني.

و قد تناولت هذه الدراسة قيـود انتقـال اثـر العقـد إلـى الخلـف العـام و الخاص، من خلال البحث في ماهية الخلـف العـام و الخـاص و مـصادر كـل منها، و التفصيل في مدى تأثرهما في الحقـوق و الالتزامـات الناشـئة عـن عقـد ابرمه سلفهما.

كما ناقشت هذه الدراسة موقف التشريع و القـضاء الأردنيـين مـن انتقـال اثر العقد إلى الخلف العام و الخاص مـن خـلال البحـث فـي القيـود و الأحكـام و الشروط التي فرضها القـانون و القـضاء علـى هـذا الانتقـال، و تنتهـي هـذه الدراسة بمجموعـة مـن النتـائج و التوصـيات الهادفـة التـي توضـح موقـف المشرع الأردني من انتقال اثر العقـد إلـى الخلـف العـام و الخـاص و معالجـة القصور التشريعي في هذا المضمار.

English Abstract

This research discusses the subject of restricting the movement of the impact of the contract to the successor contractor even this back to singular or universal successors, the subject is important because of the impact on the financial accounts for each of the backward and public sector, we believe that the number of issues related to this topic is growing every day in front of Jordanian judiciary.

This study limits the impact of the contract to move back the public and the private are detailed and simplified, through research into the nature of singular and universal successors back and the nature of each of them in detail and the extent of their impact on the rights and commitments arising from the contract between them.

The study discussed this position and Jordanian legislation eliminating the transmission of the impact of the contract back to the singular and the universal successors through the restrictions and terms and conditions imposed by the law and the elimination of this transition, and this study finished a set of findings and recommendations aimed at illustrating the position of the Jordanian legislator the transmission of the impact of the contract back to the singular and universal successors and addressing legislative shortcomings in this field.
