Arabic Abstract

• بينت هذه الدراسة أهم الضمانات التي يتمتع بها القاضـي فـي الشـريعة و القـانون، ســواء أكانــت ضــمانات ماديــة أم معنويــة، و أوضــحت أن الضــمانات المعنويــة للقاضــي تشــمل كــل مــا يتعلــق بالجانــب المعنــوي، مثــل : الاســتقرار الــوظيفي، و اســتقلال الســلطة القضائية عن السلطتين التشريعية و التنفيذية، و عدم النقـل التعسـفي، و الانتـداب، و الترقيـة، و وجـود مجموعـة مـن الحصـانات القضــائية الكفيلـة بحمايـة القاضـي مـن أي اعتـداء أو تدخل، و الاحترام الأدبي للقضاة.

أمـــا الضـــمانات الماديـــة للقاضـــي، فهـــي تشـــتمل علـــى كـــل مـــا يتعلـــق بالجانـــب المــــادي، مثــــل : الراتــــب الــــوظيفي، و مــــا يمــــنح للقضــــاة مــــن مكافــــآت و حــــوافز و ترقيــــة، و أوضـحت هـذه الدراسـة دور الضـمانات الممنوحـة للقاضـي فـي إعطائـه مزيـدا مـن الثقـة بـالنفس، و مزيـدا مـن الإخـلاص و الحيـاد و التفـاني فـي العمـل القضـائي، و بالتـالي تحقيـق العدالة للجميع، و تحقيق مقاصد توليه القضـاء و التي أهمها إنصـاف المظلـوم، و إيصال الحقوق لأهلها، و انتهت الدراسة إلى بعض النتائج و التوصيات، و اسـتعان الباحـث بمـنهج التأصـيل و المقارنـة فـي هـذه الدراسـة، إضـافة إلـى المـنهج العلمـي القـائم علـى الاسـتقراء و التحليل ضمن المنهجية العلمية.

English Abstract

This study showed the most important guarantees enjoyed by the judge in the Sharia law, whether physical collateral or spirits, and made it clear that the moral guarantees to the judge include everything related aspect moral, such as: job stability, and the independence of the judiciary from the executive and the legislature, and not arbitrary transport, and Mandate , promotion, and the presence of a group of judicial immunities to protect the judge from any aggression or intervention, and respect for the literary judges.

The material guarantees to the judge, they include everything related to the physical aspect, such as: career salary, and gives to the judges of rewards and incentives and upgrade, this study showed the role of the guarantees granted to the judge in giving him more confidence, and more sincerity, impartiality and dedication in judicial work, thereby achieving justice for all, and the achievement of the purposes of his elimination, and that the most important remedy the oppressed, and the delivery of the rights of its people, the study concluded some of the findings and recommendations, and hired a researcher approach rooting and comparison in this study, in addition to the existing scientific approach to the induction and analysis within the scientific methodology.
