Arabic Abstract
• هدفت هذه الدراسة إلى بیان أحكام القانون الأردي و القوانین المقارنة فیما یتعلق بخلو لائحة الدعوى من إحدى بیاناتها المنصوص علیها في المادة (56) من قانون أصول المحاكمات المدنیة الأردني حیث أنه تبین لي من خلال هذه الدراسة أن بعض هذه البیانات هو ضروري و لازم من أجل صحة لائحة الدعوى و البعض الآخر غیر ضروري و إنما وجوده من أجل استكمال شكلیة لائحة الدعوى و كذلك فقد قمت أیضا ببیان أثر كل ذلك لكل بیان على حده، مستشهدا بذلك بالمؤلفات الفقهیة و القرارات الصادرة عن محكمة التمییز و محكمة النقض المصریة و توصلت في النتیجة و اعتمادا على ما ذكرته إلى أن أي إغفال أو خطأ في أي من هذه البیانات یمكن تصحیحه بالطرق المحددة قانونا.
English Abstract
This study aimed at identifying the provisions of the Jordanian law as well as the comparative laws with regard to the absence of a statement from the lawsuit list from those statements which are agreed upon in the item number 56 from the Jordanian Civil Procedure Act.
This study illustrated that some of these data are necessary for the validity of the lawsuit list, while other data may not be necessary, but they must be provided for the formal purposes of completing the procedures of the trial.
I also demonstrate the impact of each statement individually, I cited the writings of jurisprudence and the decisions of the Court of Cassation as well as the Egyptian Court of Cassation.
Based on what I have mentioned in the study, I concluded that any omission or error in any of these data can be corrected in ways that are specified by law.
