Arabic Abstract

تناولت الدراسة موضوع التعويض عن فوات الفرصة في إطار المسؤولية الطبية في القانون المدني الأردني، حيث إنها تقوم بتعويض المضرور عما لحق به من ضرر نتيجة فعل محدث الضرر، و ذلك لضمان حقه في التعويض، و بالتالي تحقيق الحماية لحقوق الأفراد المضرورين.

و تكمن الحاجة في دراسة هذا الموضوع و التوقف لمناقشة السبل لتقدير قيمة التعويض عن فوات الفرصة و ما يترتب على ضياع الفرصة من آثار بالنسبة للمضرور و لمحدث الضرر في حال ثبوت شروط المسؤولية، و ما يستند عليه القاضي عند الحكم بالتعويض عنه و مقدار التعويض بالنسبة للفرصة الفائتة عليه، لا سيما أن هذه الدعوى ليست ثابتة بنص القانون المدني الأردني، مما يؤثر على حق المضرور كون تقدير الدعوى يتأرجح عادة بين دعوى فوات فرصة و دعوى الضرر الاحتمالي و التي يترك أمرها لقاضي الموضوع.

و قد قسمت هذه الدراسة إلى فصلين رئيسيين، خصص الفصل الأول لبيان ماهية فوات الفرصة في إطار المسؤولية الطبية، أما الفصل الثاني من هذه الدراسة فقد بحثنا في التعويض عن فوات الفرصة.

English Abstract

This study examines a very important topic, namely, The legal substitution in opportunity loss in medical faults in the Jordanian civil law.

This suit is important due to huge amount of claims resulting from it where it compensates the victim for the damage he incurs due to action of perpetrator to ensure his right of compensation where protection of victim's rights is accomplished.

The importance of studying this topic lies in considering principle of compensation for loss of chance and effects of this suit on the victim and the perpetrator in case conditions of the suit are established and the thing the judge depend on when delivering decision of compensation and amount of compensation as to the lost chance.

this study is important since this suit is not established in provisions of Jordanian Civil Low which affect right of the victim since deciding where the suit is a loss of chance suit or probable damage suit is left to discretion of the trial judge.

This study has been divided into two main chapters the first chapter deals with the nature of missing opportunity concept.

The second chapter explains injury substitutions in missing opportunity.
