Abstract EN

Title of treatise: (The concept of Innovation and its impact on variation of fatwa).

Name of auther: Dr.

Tariq bin Saeed Al-Qahtani.

The thought of the treatise: 1 – fixing the meaning of innovation, and mentioning the views of the scholars on it, analysing them, and favouring the correct one.

2- to clarify the difference between general welfares and between the so-called fair innovation.

3- to clarify the difference between the standard and the concept of Innovation, and its relation to the error or the difference in judgment on Innovation.

The object of the treatise: - To contribute to the community awareness of the seriousness of innovation and its bad effect.

- To Highlight the true concept of the innovation, that does not divide it into fair and bad, through the comparison between it and the misconception about innovation.

- To make a practical application of what has been clarified in this research on the issue of (the Prophet's birthday).

The most important results: 1- There is no effect of the right concept of the innovation in varying of fatwas - verdict applied-.

2- That in the centuries - favourited the difference of views about the meaning of innovation is verbal, and what after that may be real or verbal.

3- That whosoever divided the innovation, fell down in the turmoil from both sides, application and concept.

4- Incorrectness of the claim judging the invalidation of the concept (every innovation is a going astray), under the pretext of an error in the application, and that comes from three aspects: the first: from not differentiating between the standard and the concept, the second: from not differentiating between the relevance of the concept, and between the applying the practical discretionary judgment, the third: from not observance of the factors which may occur to the Mujtahid.

5- After a practical application of what has been decided about the standard of innovation, and after making a comparison between the views of the scholars who allow or ban the issue of the Prophet's birthday, and putting it in a table, it appeared that the Right is with the direction forbidding and refusing to improve the innovation of the Prophet's birthday.
