Abstract EN

The contract of arbitration occupies a prominet place in the word of today for it is effective in setting local and international disputes in the shorteset and easiest way.

It is not subject to judicial procedures imposed by the law of the civil courts.

As result , it saves the contracting parties the loss of substantial amount of mony that may incur as result of prolonging disputes among the institution that adopt the Islamic sestems in investment.

These formulae prevent the institutions from accruing interest due to delaying payment.

There fores the liability of the legal judgment of the contract guarantees achieving its purpose, other wise, it will be of no use for this end, the present paper aims identifying the liability and the proof of these judgments before the judicature.
