عقد المحاصة الزمنية (Time Share)‎ : تكييفه و أحكامه في الفقه الإسلامي

Abstract EN

This study examines the doctrinal adjustment of Time Share in a way that helps its truth and the resulting Islamic rulings.

The study concludes that Time Share contract may be adjusted according to the items of the contract and could be divided into three parts:  If the item of the contract is a material, then the contract is considered a case of sales and follows the rules of sales contract.

 If the item of the contract is a service, the contract is considered a case of rent and it follows the rules of lease contract.

As for the points system, that could be considered as money, which is considered as the price of the item of the contract is a material, and as rent if the item is a service.
