English Abstract

The conflict over Palestine has produced one of the most tragic and compelling refugee crises of the post Second World War era, Which is the Palestinian Refugee Problem.

A special feature of the Palestinian Refugee Problem is that the refugees were not citizens of a state but rather the subjects of a mandate territory being administered by the United Kingdom, under the auspices of the League of Nations, in order to prepare them for future independence.

Also their flight coincided with the creation of a new political entity, the state of Israel, on the territory they left, and the simultaneous termination of the British Mandate.

The exodus, thus, brought to an end the provisional exercise of self-determination by the Palestinians concerned, particularly as the new state of Israel refused to allow them to return.

Consequently, the Palestinian refugee problem and the Palestinian struggle for self-determination has been closely inter woven and amounting to two sides of the same coin.

The study will shed light on the probable policies and trends that can be followed to reach a final, permanent, comprehensive, and practical solution to the Palestinians refugee problem.

It will study the to what extant, we can reach the wanted resolution depending on the Palestinian awareness of their historical, legal right of return to their homeland.

Or the probability to do that depending on the rules of international law.

Or according to the final political negotiations which will be held depending on the existing balance of powers.

Finally, the study proposes for the Palestinian refugees, as final policy, not to involve in reaching a solution and waiting for any change in the future can affect the balance of powers towards their interests.

Waiting with doing hard with all their best to achieve their goals.

The study looks to this policy as a best alternative from getting in negotiations for an unacceptable solution.

The writer hypothesizes that the main elements of the solution are durability and continuity, acceptability, comprehension, acceptability of practical application.

He also hypothesizes that the measurements for these elements will be; to what extent that solution can accommodating both sides minimum national interests.

For the Israeli, they are the security concerns, the normalization of the relationships with Arab countries, and the recognition with Israel as a normal state in the area.

In the other side, for the Palestinian, they are the need for the Palestinian Independence State, right of return and self-determination.

For the problem of the study is considered one of the main International Political Relations issues.

The study commit itself to a set of analytical approaches of the International Relations concentrating on the three dimensions of the issue, historical, legal, and political one.

So, to be convent to the core of the study.

According to the writer, the negotiations should first and foremost address the issue of the territorial status of the occupied Palestinian territories in 1967.

Only once the core issue of Palestinian Sovereignty has been resolved through establishing the Palestinian legal state (De Jure), according to the General Assembly resolution (181), to be actual state (De Facto).

So, the occupied territories are parts from that Palestinian legal state; part of it, which under the Palestinian authority is liberated one, which is the A areas.

The other one is still under the Israeli occupation.

This legal status will enable the parties to deal with other outstanding issues including that of refugees and borders.

The study emphasizes that a just, comprehensive, and durable solution to the refugee issue does not depend exclusively on Israeli Palestinian agreement, but requires the involvement of many other parties including; the Arab countries, Europe, United states, United Nations, donor countries and other international organizations with a vested interest in stability in the region.

The study has come up with a solution depending on the final political negotiations, which should be conducted under the conditions of the existing balance of powers in two stages.

During the first, bilateral stage, Palestinian and Israeli negotiators are to agree on the principles that should govern a comprehensive, final solution like; the Question of Responsibility, the Right of Return, and the Question of compensation.

The second, multilateral stage, an international conference should be convened, similar to those held to work out comprehensive final solutions for other refugee problems, with aim to agree upon an integrated approach towards the political, humanitarian and developmental dimensions like; housing and socio-economic rehabilitation of the refugees.

The study discusses the three policies and trends, and reaching to the conclusion that no one of them can provide us with a complete framework to the durable solution.

The solution which must be permanent, acceptable, comprehensive, and the acceptability to the practical application.

So, the study prefers to take the trend, not to involve or to agree to a solution rather than to reaching unacceptable one.
