The legal nature of the division is a binding contract.

(Article730 of Algerian civil law), coowners can share their common property in the way they want, the division may be a consensual partition (as stipulated in article 723).

When co-owners do not agree on dividing their property, the person rejecting the division should claim it with court proceedings (Judicial partition article724).Co-owners can share their property through the partition of usufruct (article 733).

Tout co-indivisaire peut demander le partage d’une propriété commune.

Les co-propriétaires peuvent, s'ils sont tous d'accord, partager leur propriété commune, de la manière qu'ils veulent.

Si les co-indivisaires ne sont pas d'accord sur le partage, celui qui veut faire cesser l'état d'indivision doit assigner les autres co-indivisaires devant le tribunal (partage judiciaire article 724).

Les co-indivisaires peuvent partager la chose commune par le partage provisionnel (article 733).
