Abstract EN

Reaching a settlement between heirs is very important in inheritance science, as it is a significant agreement for the transfer of property and for the sharing of the succession, particularly of movable and immovable property that cannot be shared fairly, or the sharing of which shall damage it or diminish its current value.

This paper tackles settlement agreement for its practical importance in the sharing of inherited estates.

This study is divided into four parts: an introduction in which is set the general scope of the study, the main problematic and the question derived from it, the used methodology.

In the first part we gave the definition of the settlement agreement.

In the second part we dealt with the conditions of it, its types and provisions.

It the last of this paper we discussed the method of sharing inherited estates by way of settlement agreement in which we presented five cases.

We concluded this research by citing the most substantial results.
