It’s possible , that the administration hase some thing of liberty of action ,and the power of the choosing its behaviour in front of this fonction .

In thefirste case , we are in front of what they called the discrétionnary power of the adminstration .

where as in the second case , we are in front of the tie-upcompétence .

But the administration ignore the principal of the legality in front of choosing this acts .

So , the discrétionnary power of the administration have to be exercised in the limit of the legale principale
