Abstract EN

This study aims to investigate time-sharing contracts in terms of the concept, forms and various applications in order to arrive at a Shari‘ah characterization of them.

The research employed a historical methodology by investigating the origins and developments of the concept, especially in the West.

It then used an analytical and comparative methodology by exploring the contracts that resemble this type of contract and comparing the various characterizations of the concept in Islamic fiqh terms.

The research arrived at a number of conclusions, the most important of them being that time-sharing contracts of both types -i.e., sale and lease- come under the rubric of sale and lease contracts in Islamic jurisprudence.

Based upon that, the basic rule for the category is that it is, in principle, lawful.
