Abstract EN

I have attempted in my research to demonstrate, in brief, the principles and foundations of financial transactions, painting a general picture of the subject as described by the scholars of fiqh.

This was done to aid students in understanding how the science of fiqh conceptualises and theorises issues (masa’il) related to financial transactions in order to present the best solutions to these matters.

This paper explains the flexibility entertained by scholars when establishing the various rulings related to transactions.

This flexibility is considered the reason behind the success of the shariah in answering the transactional needs of people.

I also speak about how the legal rulings of transactions organise human life, and I then clarify the general principles upon which these legal rulings are built.

Furthermore, I explain how these theoretical rulings observe and comply with the real world.

I then speak about the freedom of acting within the sphere of transactions, and how the default position in it is permissibility.

To assist in understanding the material, I introduce the paper by defining the concept of financial transactions and wealth itself.

To summarise, I end it with the most important results arrived at in this paper.
