التجربة الاتحادية في العراق : علاقة القوانين الاتحادية بقوانين الأقاليم في الدستور العراقي الدائم لسنة 2005 : دراسة مقارنة

Abstract EN

federal state is a federation among territories or states are characterized by ethnics, nations , language , religion or culture to be of one legal entity keeping the independency these united personalities with its privacy and identity keeping the autonomy for these parts which is the most advantage of this federation.

Through this study it is made a comparative analytical with the federal states constitution of deep experience proving its succeeding such as USA Constitution of 1787 and the basic law of Germany of 1949 in the subject of the main political and economical problem that resulted from the relation between the federal laws and the territories laws , this is studied as an introduction to study a federal state in Iraq according to Iraqi Permanent Constitution of 2005, so that it is studied the principles and the accredited in these federal international models especially in regards to the relation of federal laws with the territories laws through comparing it with US Constitutions and the basic law of Germany.

The most important conclusions are Iraqi Permanent Constitution gave the priority for the territories law rather than federal laws in case of occurrence a conflict between them in regards to the common or mutual specialties in contrary with the under-comparison federal constitutions.
