Arabic Abstract

تطرقت هذه الدراسة إلى "مدى مشروعية التدخل العسكري الإنساني في القانون الدولي العام وتطبيقاته العملية"، و التي تفترض أن التدخل العسكري الإنساني و أن كان مستندا إلى الإطار القانوني إلا أنه يبقى يحمل معه أهدافا و مقاصدَ سياسية.

إلا أن هذه الأهداف و المقاصد يرى أنصارها أنها شرعية من الناحية القانونية، لوجود مبررات إنسانيه، و تبقى هذه المبررات العامل الرئيسي لشرعية التدخل في الشؤون الداخلية للدول الأخرى.

لذا سوف تحاول هذه الدراسة بيان إشكالية التعارض بين ظاهرة التدخل و مبدأ و سيادة الدولة، و كذلك تسعى إلى توضيح آليات التطابق و الاختلاف بين مفهوم التدخل الإنساني و مفهوم التدخل العسكري الإنساني وفقا للصكوك الدولية.

و مع بيان بعض الأمثلة التطبيقية التي شهدتها الساحات الدولية لعمليات التدخل، و ذلك بالاعتماد على المنهج التاريخي و الوصفي الاستقرائي.

من خلال دراسة و تحليل التطبيقات العملية للتدخل العسكري الإنساني، وجدنا أن تلك الدول قد اتخذت التدخل غطاء باسم الإنسانية بحجة حماية حقوق الإنسان و ذلك ضمن النظام الدولي الجديد، و عليه فإن التدخل العسكري الإنساني ما هو إلا عملية تبريرية توفر غطاءً للمشروعية الدولية لكي تتدخل الدول الكبرى في الشؤون الداخلية للدول الصغرى و على رأسهم الولايات المتحدة الأمريكية و هذا يعد انتهاكا لمبدأ سيادة الدولة.

English Abstract

This study aimed at investigating the legitimacy of the humanitarian military intervention in the International Law and its practical applications, which assumes that while humanitarian military intervention depends on a legal framework, it still implies political objectives and targets as well.

The supporters of these objectives and targets find that such objectives and targets are legitimate from the legal aspect, because there are humanitarian justifications for the same and these justifications remain the main factor for the legitimacy of the intervention in internal affairs of the other state.

Therefore, this study aimed to reveal the problem of contradiction between the phenomenon of intervention and the principal of state sovereignty and seeks to clarify the mechanisms of conformity of difference between the concept of humanitarian intervention and the humanitarian military intervention according to the International Instruments.

Moreover, the study highlights practical examples witnessed by the international arenas as for the intervention processes using the historical descriptive and inductive method.

Based upon this study and the analysis of the practical applications of the humanitarian military intervention, we findings revealed that such states have taken the intervention as cover in name of the humanity under the pretense of protecting the human rights within the new international system.

Thereupon, the humanitarian military intervention is just a justification, which provides a cover for the international legitimacy, so that the major states - on top of them the United States of America - can intervene in the internal affairs of the minor states and this is considered as violation to the principle of state's sovereignty.
