Abstract EN

The incident opponent, who has never been as a party in the instance of the first degree court, is basically not allowed to interfere directly in the dispute of the second degree court, with some exceptions in the comparative law.

This important rule is considered as a result of respecting the principle of double degree judgment.

It is noted from the comparative law trend, that the rule of not accepting new demands at the appeal stage became from the past, and wasn’t an apsolute base anymore.

In the time being, some legislations don’t mind to accept a sort of incedent applications such as the intervention accessory which does not constitue any conflict with the principal of double degrees judgement, while others don’t reject to accept even the offensive demends which are considered against the traditional principal of appeal system.

The study concluded that it may be necessary following the examples of the comparative legislation, especially those whom we consider as our historical resourse.

In this regard, we ask the Jordan legislative to modify our civil procedure law to the approach of permitting and approving, at least the intervention accessory demand.
