This study aimed at answering the most prominent question with regard to the application of the rules of the Jordanian Civil Retirement law on Members of Parliament and Ministers in Jordan, by identifying their legal status in the Jordanian Constitutional System in light with the resolution issued by the Constitutional Court Jordan No.

(2) for the year 2014, which ruled against regarding membership of the Jordanian Parliament and its duration for the purpose of applying the Civil Retirement Law, and that members of Parliament are not entitled to receive pensions.

This study also addressed the legal status of an MP and Senate from one side and a minister in Government in the other in all previous constitutions issued in the Hashemite Kingdom of Jordan, since its establishment up until the current Constitution of 1952, and it concluded that the Resolution of the Constitutional Court with regard to granting pensions to Ministers only without members of Parliament in Jordan was correct, since Ministers could be legally seen as public officers for the sake of receiving pensions pursuant to the Civil Retirement Law.
