Abstract EN

The study throws spotlight on deportation measure which means deportation of a foreigner from the country to preserve its security from outlaws.

Deportation is meant to safeguard the country by uprooting criminals who pose danger to social and economic security.

Deportation is the undisputed right of the country, however it should be justifiable not an arbitrary one.

Foreign residents have to abide by the laws and regulations of the country to avoid harsh penalties.

Study tackled the various aspects of deportation measure as a freedom – restricting penalty.

Deportation penalty can be a judicial one issued by the judge and also can be an administrative one decided on security grounds to preserve security and stability of residents.

According to law, the person on which deportation penalty is imposed should be foreigner, and execution of the penalty should not be suspended.

Notwithstanding the right of the country to impose deportation penalty which is also not violating human rights, yet this penalty has its own demerits, including its failure to realize the objective of punishment.

Another demerit is that it is tougher than other freedom – restricting penalties.

As UAE newly introduced laws tend to approve deportation penalty, study suggests some recommendations to boost the effectiveness of this penalty and avoid criticism.

Study enumerated merits and demerits of deportation as well as its forms and objectives.

Recommendations included setting and updating special rules for deportation.
