Arabic Abstract

تهدف هذه الدراسة إلى استخلاص و جمع القواعد الفقهية عند الإمام المرغيناني، أحد أبرز أئمة المذهب الحنفي، من خلال كتابه القيم "الهداية شرح بداية المبتدي" و من ثم شرح القواعد الفقهية المستلخصة و بيان و أدلتها، و كذلك بيان تطبيقاتها التي تندرج تحتها خاصة في الطهارة و الصلاة.

و مما تناولته هذه الدراسة أدبيات الدراسة و إطارها النظري، و التعريف بالأمام المرغيناني و كتابه " الهداية شرح بداية المبتدي"، و مذهبه و مكانته في المذهب الحنفي و شيوخه و تلامذته و مؤلفاته و نبذة عن كتابه، ثم التعريف بالقاعدة الفقهية و اهمية القواعد و منزلتها و الاستدلال بها عند الحنفية من خلال كتاب" الهداية" و أقسام القواعد الفقهية و مصنفات علم القواعد الفقهية عند الحنفية من خلال كتاب "الهداية" و سمات منهج المرغيناني في القواعد الفقهية من خلال كتابه الهداية ثم استخراج القواعد الفقهية عند المرغيناني في بابي الطهارة و الصلاة ثم بيان مفردات القواعد لغة و اصطلاحا و معناها الإجمالي و أدلتها ان وجدت ثم استخراج التطبيقات من كتاب الهداية ثم وضعت خاتمة اشتملت على اهم النتائج و التوصيات.

و من ابرز ما خلصت له الدراسة كشفت عن جوانب مهمة في حياة الإمام المرغيناني و جهوده العلمية و بينت الدراسة اعتناء المرغيناني بالقواعد الفقهية في كتابه " الهداية شرح بداية المبتدي"، و تضمنت الدراسة أربعة فصول و خاتمة.

English Abstract

This study aimed at investigating and collecting the juristic rules for the imam Al-Margenani, one of the most prominent followers for Al- Hanafi doctrine, by examining his book " Al-Hedaya, explaining the beginning of the beginner", and then explaining the extracted juristic rules as well as clarifying their evidences, in addition to demonstrating their applications that are related to chastity and prayer.

This study addressed the literature of the study, its theoretical framework as well as identifying the imam Al-Margenani and his book " Al-Hedaya, explaining the beginning of the beginner", his doctrine and his position in the Hanafi doctrine as well as his teachers, students, writings and a brief view about his book.

After that, I identified the juristic rules, the importance of the juristic rules, their rank and using them as evidences in the Hanafi doctrine via the book of " Al-Hedaya", as well as identifying the parts of the juristic rules and the classifications of the juristic rules in the Hanafi doctrine through the book of " Al-Hedaya", the characteristics of Al-Margenani approach in the juristic rules via the book of " Al- Hedaya", and finding out the juristic rules of Al-Margenani regarding chastity and prayer, in addition to demonstrating the terminology of the rules linguistically and conceptually as well as their total meaning and evidences, and extracting the applications from the book of " Al-Hedaya".

Finally, I cited a conclusion that included the most important results and recommendations.

The most important results of the study included a revealing about important aspects in the life of the imam Al-Margenani and his scientific efforts.

The study demonstrated that Al-Margenani was interested in the juristic rules in his book " Al-Hedaya, explaining the beginning of the beginner".

The study consisted of four chapters and a conclusion.
