The equality is the basis for all democratic society who desire to the social justic and human rights in all societies and almost in all kinds of activities.

The woman face inequality actually this situation results from existence discrimination in family and community between the man and woman ‘ and according to the fatherly traditional values which be devoted to put the woman under the masculine guardianship in the family the discrimination against woman is staying widespread .

this discrimination is supported by existence the wild opinian which is not changing and the religious and cultural habbits and traditions which hurt woman .

I will try in this research to focus on the rights of woman as human rights under judgements and provisions of the indulgently islamic sharia which is form turning point in the intersting with problems of woman world wide .
