Arabic Abstract

تناولت الرسالة الاختيارات الفقهية لابن عابدين في قضايا الزواج و الطلاق، من خلال حاشيته؛ و اختصت بقضايا الزواج و الطلاق؛ لكونها من أهم القضايا التي يكثر السؤال عنها و يقع الاختلاف فيها، و تهدف هذه الرسالة إلى إبراز مكانة ابن عابدين و اختياراته، حيث أنه حنفي المذهب، و صرح كثيراً بعدم خروجه عن أقوال مذهبه.

وكان منهجه في حاشيته يتمثل بالشرح الفقهي المفصل وذكر الأقوال الفقهية و ترجيح ما يراه مناسباً.

و تعتبر حاشيته خلاصة نتاج المذهب الحنفي منذ نشأته إلى زمن ابن عابدين.

و كان منهج الباحث قائماً على ذكر اختيارات ابن عابدين في قضايا الزواج و الطلاق بدايةً و مقارنتها مع غيرها من أقول الفقهاء، ثم ذكر الترجيح بين هذه الأقوال.

مستخدماً في ذلك المنهج الاستقصائي و منهج المقارنة و المنهج التحليلي.

ويتوقع الباحث الوصول إلى النتائج الآتية: ۱- هل بلغ ابن عابدين منزلة علمية تجعلنا نعتبر باختياراته وترجيحاته؟ ۲- هل خالف ابن عابدين مذهبه الحنفي؟ -3 هل اعتبر ابن عابدين بأثر تغير الزمان على الفتوى؟

English Abstract

The dissertation approached the jurisprudential selections of Ibn Abdin in the marriage and divorce issues through his annotation.

Because it is one of the most important issues that are frequently asked about and is the difference in it, and the purpose of this letter to highlight the position of Ibn Abidin and his choices, as he Hanafi doctrine, and said much not to abandon the words of doctrine.

And his approach in his entourage is a detailed explanation of the jurisprudence and the words of jurisprudence and the weight of what he sees fit.

And its marginalization is considered as a summary of the product of the Hanafi doctrine from its inception to the time of Ibn Abidin.

The approach of the researcher based on the mention of Ibn Abidin's choices in the issues of marriage and divorce start and compare with other jurists say, and then the weighting between these statements.

Using the survey approach, the comparative approach and the analytical approach.

The researcher expects to reach the following results : 1 - Did Ibn 'Abidin reach a scientific status that hastens us to consider his choices and his calamities? 2 - Did Ibn Abidin disagree with his Hanafi doctrine? 3 - Did Ibn Abidin consider the effect of changing time on fatwa?
