Arabic Abstract

تعتبر عقود البناء و التشغيل و نقل الملكية من أهم العقود الادارية التي تكون نتائجها مثمرة على التنمية الاقتصادية في الدول, لأنه من خلالها يتم البناء المرافق العامة للدولة لتقديم الخدمة للمواطنين دون أي تكلفة مالية على الميزانية العاتمة, و لكونها عقود تكون منازعاتها ذات طابع قانوني مختلف عن العقود الادارية الاخرى لان أحد أطرافها شخص من أشخاص القانون العام و هي الدولة, و الطرف الآخر شخص من أشخاص القانون الخاص و لأنها ذات طابع قانوني مختلف عن العقود الادارية الاخرى لان أحد اطرافها شخص من اشخاص القانون العام و هي الدولة, و الطرف الاخر شخص من أشخاص القانون الخاص و لأنها ذات طابع قانوني مختلف حاولت أن أقوم من خلال هذه الدراسة بتوضيح ماهية هذه العقود و سبب اختلافها عن العقود الأخرى و تكيفها القانوني و الاثار المترتبة على العقود و كيفية تسوية المنازعات التي تتم فيها و ختاما بعض التوصيات التي أراها مهمة عجلة التطور في هذه العقود.

English Abstract

The contract of construction, operation and moving of properties contract are considered among the most important management contracts, with a profile prosperous results on the economic growth of the contracts, because through them the public facilities are constructed, which in turn provides services to the citizens without any real financial cost on the public economic budget, but they're contracts with a different prospective legally than the other management contracts because one of the parties in those contracts are the public which means the country's government and their representative employee, and the other party is from the private sector or special law, and because of their special legal situation, I tried through this study to explain what are those contracts are, and why Tay are different from the other types of contracts, and how to deal with them from a legal point of view and the results of these contracts, as well as how to work out the legal disputes in them, and in an offer one recommendations which from me prospective are important to evilve and progress with these contracts.
