Arabic Abstract
هدفت الدراسة إلى إلقاء الضوء على قانون المالكين و المستأجرين و تعديلاته التي تعنى بحماية المستأجر، إضافة إلى مجموعة من مواد القانون المدني التي تمس حياة المستأجر، و استقراره، و طمأنينته، مما يؤدي إلى استقرار المجتمع، إذ أن هناك شريحة كبيرة من الناس مستأجرين لعقارات سواء أكانت معدة للسكن أم لغيرها، و لتحقيق أهداف الدراسة فقد حللت المواد المتعلقة بمظاهر الحماية القانُونيَّة للمُستأجر و حق المؤجر بالإخلاء و حق المُسْتأجر بالبقاء، و دعوى استرداد العقار المأجور، و دعوى منع المعارضة في منفعة المأجور.
و قد حاولت الدراسة إيجاد مخارج قانونية في النصوص المتاحة مع دعوة المُشرع الأردني إلى تعديل بعض نصوص قانون المالكين و المُسْتأجرين لمراعاة التصرفات القانونية التي يجريها المُسْتأجر على حقه في الإيجار باعتباره حقا شخصيا، و قد اعتمدت الدراسة على المنهج المقارن و المنهج التحليلي و التطبيقي، من أجل الإجابة أسئلة الدراسة و تحقيقا لأهدافها، و قد تناولت الدراسة مفهوم عقد الإيجار، و مظاهر الحماية القَانُونيَّة للمُستأجر، و الموازنة بين حق المؤجر بالإخلاء و حق المُسْتأجر عن بالبقاء.
و انتهت الدراسة بخاتمة تضمنت النتائج التي ظهرت من خلال دراسة و تحليل قانون المالكين و المستأجرين و تعديلاته، و بناء على النتائج فقد خرجت الدراسة ببعض التوصيات.
English Abstract
The study aimed at shedding light on the law of owners and tenants and its amendments that concern the protection of the tenant, in addition to a set of civil law articles that affect the tenant's life, stability and tranquility, which leads to the stability of the community.
There is a large segment of people who are tenants of real estate or to others.
In order to achieve the objectives of the study, the articles concerning the legal protections of the tenant, the right of the lessor to evict and the right of the tenant to stay, the claim to recover the rented property, and the claim to prevent the opposition in the benefit of the wage were analyzed.
The study attempted to find legal exits in the available texts, with the Jordanian legislator calling for the amendment of some provisions of the law of owners and tenants to take into account the legal actions taken by the tenant on his right to rent as a personal right.
The study relied on the comparative approach and the analytical and applied method, The study dealt with the concept of the lease, the legal aspects of the tenant's protection, the balance between the landlord's right to eviction and the right of the tenant to stay.
The study concluded with a conclusion that included the results of the study and analysis of the owners 'and tenants' law and its amendments.
Based on the results, the study came out with some recommendations.
