Abstract EN

The present study aims to investigate the legitimate rights of abandoned children.

The study includes an introduction, three chapters, and a conclusion.

The introduction includes the significance and the rationale of the study.

The first chapter investigates the word 'right' as a lexeme and as a notion, and examines the related concepts.

The second chapter examines the legitimate rights of abandoned children.

The third chapter investigates the effort made by the Kingdom of Saudi Arabia in caring for the rights guaranteed to the abandoned children through Islamic law.

This paper identifies the authorities responsible for the provision of welfare assistance to the abandoned children, and the formal procedures embedded in the Saudi system that cares for the children whose parents are unknown.

The conclusion includes the major results of the study, such as: (i) how Islamic law is superior to other international covenants that call for human rights and the rights of the child, where fifteen centuries ago, this tolerant legitimacy has laid all the rights related to abandoned children, (ii) the kingdom of Saudi Arabia has pioneered in this area, as it takes from Islamic law a platform for rules and transactions, (iii) the rules and regulations established by the Saudi government include: (a) Islamic law necessitates the protection of abandoned children and forbids leaving them exposed to danger or death, (b) the guardian of the Kingdom is committed to take care of this group of children and ensures their right, (c) the government stipulate certain conditions for those who wish to provide care for the abandoned child with continuous follow-up in order to ensure that he/she is well-cared for psychologically, physically, and morally, (d) develop solutions that limit the growth of this social phenomenon and address it from a legitimate perspective.
