Abstract EN

This article focuses on an attempt to examine the mechanisms adopted within the framework of international criminal justice for the application of the system of "Grave breaches" of international humanitarian law - previously limited only to international conflicts - to non-international armed conflicts.

This is due to the dichotomy of applicable regulations between the two armed conflicts regimes in international instruments of international humanitarian law and, to that posture of duality which has emerged a growing interest in the corridors of international criminal tribunals, to approach the regulations applicable in the two types of armed conflicts.
