Abstract EN

The marital expense one of the effects of the marriage and the right of Financial wife, and because of the rapid changes in the financial side of the couple and exit of the wife to work and the failure to regulate the provisions of alimony of the wife working in the Iraqi Personal Status Law, appeared several problems in the center of the family, especially between spouses "So this study came several treatments for this problem, derived from religious texts in the Qur'an and Sunnah and the opinions of scholars and the Iraqi, Jordanian law, pointing out the most likely jurisprudence and the proposal by taking in Iraqi law to avoid the shortage in Iraqi law by referring to what has been organized in the Personal Status Jordanian "law, therefore, has been the division of research into two sections, where we dealt with in the first part of what alimony defined through evidence and the statement of legitimacy, cause and conditions and elements.

The second section has touched the controls wife's work and its impact on the right of the wife working in alimony, we have reached the most important results of "scholars agreed that the working wife deserves alimony in the event of her husband's permission work unconditionally, in the case of the requirement of its work in the marriage contract or silence the husband for the wife out to work, Iraqi Personal Status Law and Jordan has taken the opinion of the majority of scholars in the issue of working wife alimony; but Iraqi legislator did not regulate this issue in a direct and independent "So we proposed amendment Iraqi Personal Status Law and regulate the issue of working wife alimony has also been organized in the Jordanian Personal Status Law.
