English Abstract

It is no doubt that however studied the Islamic Sharia, would know that it put solid foundations for preserving the life and dignity of the human being in wars and peace.

The Islamic Sharia paved the way for what we call the rules of law or what is called nowadays the international humanitarian law.

The international humanitarian law and Islamic Sharia have common rules and foundations that preserve the lives of the human beings and their dignity whether dead or alive.

Some of these rules include the prevention of indiscriminate attacks that are usually directed at unidentified targets unless necessary.

The research tackles the definition of indiscriminate attacks in Islamic Sharia and international humanitarian law according to Additional Protocol I (1977) and their relation with the principle of necessity and how this principle is explained in Islamic Sharia.

Another part also includes warning against using indiscriminate attacks in Islamic Sharia and international humanitarian law and how they can be used for necessity in Islamic Sharia and international humanitarian law.
