English Abstract

Protection of Women, Children and the Elderly during Armed Conflicts in the Islamic Sharia Law and the International Humanitarian Law This study examines the International Humanitarian Law and connects its articles to the provisions of the Islamic Sharia Law in regards with the protection of women, children and the elderly during wars.

The Islamic law was enacted hundreds of years before the International Humanitarian Law and founded legislations for war prevention when possible and other legislations hat impose control on the conduct of the Muslim army when war erupts.

The first topic discussion compares the principles of military operations between the Islamic law and the International Humanitarian Law such as : humanitarian treatment of others, differentiating between warriors and nonwarriors proportionality of actions to the situation and the military necessity.

The second topic of discussion in this study discusses the right of protection of women, children and the elderly during wars in both the Islamic law and the International Humanitarian Law.

Finally the study draws a number of important conclusions and proposes a number of recommendations by both researchers.
