Abstract EN

This article aims to examine the question of polygamy, one of the issues that raised considerable controversy and is still affecting the rights of women in Islamic countries and in Algeria in particular.

In order to shed light on the evolution that has occurred on family legislation in those countries with a view to the restriction of this phenomenon by putting under the control of the judge.

It has been shown through this research that some of these countries already banned polygamy and other permissible in accordance with the general conditions in the Islamic Sharia.

While most of the most developed of these countries has obliged the judge not to conclude a marriage contract in the case of polygamy only after confirming certain conditions are achieved.

If some countries non-Arab Muslim has expanded the conditions under which a judge confirm achieved is the number of wives, justice and the ability to alimony, the Algerian Family Code was limited to general conditions and added to the consent of the first wife and the second woman to be married, and legal justification which did not specify his controls.
