The right to a fair trial is one of the most basic rights enjoyed by humans, and this is particularly important in the context of a criminal proceeding, whereby it is an indispensable means of protection of the rights and freedoms of individuals and their personal security, which may be violated as a result of non-observance of procedures governing this criminal proceeding, or as a result of an individual’s unlawfully criminal punishment of unlawfully.

This research study seeks to identify guarantees and standards of rights to a fair trial given to the accused before the permanent International Criminal Court, both those derived from the principles of legitimacy of the International Criminal or presumption of innocence
