Bankruptcy is one of the most important offences in business.

The Algerian legislator has strengthened the protection of the creditors of the bankrupt corporation.

Some exceptional rules are adopted to deal with liability of managers of Both limited liability companies by shares and public limited companies in case of corruption.

In addition, the legislator imposes penalties on managers when they commit both simple and fraudulent bankruptcy .For this purpose, this article will focus on two issues : first the material and moral elements, second judicial pursuit and sanctions.
