Under the successive Algerian constitutions Islam is the state religion; but the concept of religion has different meanings in Islam and the west .Analysing the concept of religion in the light of the current Algerian constitution, and in the light of international instruments of human rights adopted by Algeria and unofficial practice, it appears that the current constitution has adopted the western conception of religion rather than Islamic conception.

Les constitutions algériennes prévoient que l’Islam est la religion d'État.
Toutefois, le concept de religion a des significations différentes dans l'Islam et l'Occident..L'analyse de la notion de religion à la lumière de la Constitution algérienne actuelle, et à la lumière de la pratique officielle à travers l’adoption des instruments des droits de l’homme ainsi que la pratique non officielle.
Il semble que la constitution actuelle a adopté le concept occidental de la religion plutôt que le concept islamique .
