Arabic Abstract

تناقش هذه الدراسة أحكام حجية القرائن القانونية القاطعة في الإثبات المدني، متناولا فيها ابتداء في الفصل التمهيدي مفهوم القرائن القانونية بشكل عام و مبررات تقرير القرائن القانونية و خصائصها و أنواعها و تميزها عن بعضها البعض، و تناول الفصل الثاني دور القرائن القانونية القاطعة في مجال الإثبات المدني، من حيث معيار تحديد القرينة القانونية القاطعة و عملية إثبات عكس القرينة القانونية القاطعة و مدى إمكانية اعتبار القرائن القانونية القاطعة دليلا من أدلة الإثبات، و سرد بعض التطبيقات في مجال القرينة القانونية القاطعة، بينما تناول الفصل الثاني حجية الأمر المقضي كونه يعتبر من القرائن القانونية القاطعة و ذلك من حيث التعريف بالحجية و أساسها و مدى تعلقها بالنظام العام و ما هي شروط قيام حجية الأمر المقضي حتى يحوز الحجية و الشروط الواجب توافرها في الحق المدعى عليه، وأيضا يتناول هذا الفصل حجية الحكم الجزائي أمام المحاكم المدنية، كل ذلك مستشهدا بنصوص مواد القانون الأردني و قرارات محكمة التمييز الأردنية، وقد استعان الباحث بالمنهج التحليلي في هذه الدراسة التي تعنى بتحليل النصوص القانونية ذات الصلة في كل من الفصول الثلاثة، و دراسة الأبحاث و الدراسات السابقة و المؤلفات للوصول الى المعلومة و بيان وجهات النظر للباحثين في هذا الموضوع و ستخلص هذه الدراسة الى الوصايا و الاستنتاجات و التي تم التوصل اليها.

English Abstract

This study discusses the provisions of the authoritative legal presumptions unequivocal in civil proof، addressing where، starting in the introductory chapter the concept of legal presumptions in general and the justifications for legal presumptions and characteristics، types and distinguish a report on each other، and the second chapter the role of legal presumptions unequivocal in the field of civil proof in terms of the criteria for determining the context legal incisor and the process of proving the opposite legal context incisor and the possibility of consideration of legal presumptions unequivocal proof of evidence and listed some of the applications in the field of legal presumption unequivocal at the end of this chapter، while Chapter II took Authentic res judicata being considered one of the clues legal unequivocal in terms of definition authentic and it's orginal and how it attaches to public order and what are the terms of the authentic res judicata even authentic possession and the conditions to be met by the right of the defendant and also this chapter deals with authentic penal judgment in the civil courts، all citing the provisions of Jordanian law materials and the decisions of the Court of Cassation Jordan، has hired a researcher analytical approach in this study، which analyze the relevant legal texts in each of the three chapters، the study of research and previous studies and literature to gain access to information and the statement of the views of the researchers in the subject of this study and will be saved to the commandments and the conclusions that have been reached
