Arabic Abstract

هدفت هذه الدراسة لتقصي تعارض النافي و المثبت و أثره في اختلاف الفقهاء، و سعت الدراسة لتفسير المباحث و تحليلها و مقارنتها للوصول إلى نتائج مقبولة، و ترجيحات سليمة في المختلف منها. تناولت بناء على طبيعة الموضوع أن تكون الدراسة في أربعة فصول و خاتمة : الفصل الأول : و المعنون بخلفية الدراسة و أهميتها ؛ تحدثت عن مشكلة الدراسة، و أهميتها و سبب اختيارها، و عن الجهود السابقة التي بذلت في الكتابة فيها، ثم بينت المنهج الذي سأسلكه في الكتابة و جمع المعلومات.

و الفصل الثاني : تحدثت عن التعريف بالمصطلحات و بعض مسائلها ؛ فتناولت تعريف التعارض و بعض مسائله، و ذلك ببيان معنى التعارض و أركانه و شروطه، و أسبابه و محله، و تحدثت عن مفهوم النافي و المثبت ؛ فبينت معنى النافي و صيغه، و معنى المثبت.

أما الفصل الثالث : فقد تناول تطبيقات معاصرة على أثر التعارض بين النافي و المثبت، فتناولت التطبيقات المالية المعاصرة، و التأمين وحكمه، وبيع المرابحة للآمر بالشراء، و تحدثت كذلك عن أثر التعارض في القضايا الطبية، فتناولت الأحكام الشرعية في الموت، و تشريح جثة الميت، و نقل الأعضاء البشرية.

و في الخاتمة خلصت إلى جملة من النتائج و التوصيات.

English Abstract

The main aim of this study is to investigate the contradiction between the affirmed and the disaffirmed and its impact on the disagreement of theologians.

The researcher used the inductive, the descriptive, and the analytical methods.

The study sought to explain, analyze, and compare the findings to reach an acceptable results.

The study consisted of four chapters and a conclusion; In the first chapter: with the title of " background and importance of the study", I talked about the problem of the study, its importance and the reasons for its selection, then I discussed the previous efforts that were made in writing about it, after that I explained the method that I will choose in writing and gathering information.

The second chapter dealt with the definition of terms and some of its issues.

It dealt with the definition of contradiction, its structure, its conditions, its causes, and its position.

The Chapter three dealt with a modern applications about the contradictions between the affirmed and the disaffirmed.

It dealt with modern financial applications, insurance, the sale of Murabaha, and the impact of disagreement in medical cases.

Dead, and human organs transfer.

In conclusion, I came up with a set of conclusions and recommendations, followed by sources and references
