Arabic Abstract

جاءت هذه الدراسة لتتناول موضوع ضمان الاستحقاق في البيوع القضائية، فوجدنا أن المشرع الأردني لم ينظم أحكام ضمان الاستحقاق في البيوع القضائية و ترك حكمه للقواعد العامة التي تستوعب في نصوصها هذا الضمان، و ذلك على خلاف المشرع المصري الذي نظم أحكامه في المادة (416) من قانون المرافعات المدنية و التجارية المصري.

و انتهت الدراسة إلى أن كلا النصوص الواردة في التشريعات الأردنية و المصرية محل الدراسة قد خولت من يرسو عليه المزاد حقوقا قبل المستحق و البائع منها الحق في طلب استرداد الثمن الذي دفعه، والتعويض عن الأضرار التي لحقت به من جراء واقعة الاستحقاق.

ولكن عند إجراء المقارنة بين الأحكام الواردة في القانون المدني الأردني وبين نص المادة (416) من قانون المرافعات المدنية و التجارية المصري، وجد الباحث أن المشرع الأردني كانت له الأفضلية على المشرع المصري في تحديد الشخص الملتزم برد الثمن و التعويض للمشتري، بينما لم تحدد المادة (416 مرافعات مصري) الشخص الملتزم برد الثمن و التعويض.

و أما أهم التوصيات فكانت أن يحدد المشرع الأردني في قانون التنفيذ مدة زمنية لتسجيل قرار الإحالة القطعية، كما فعل المشرع المصري في قانون المرافعات المصري، و ذلك حتى تكون حجة على الغير.

و أن يقوم المشرع الأردني بإعادة النظر في المادة (20) من قانون التنفيذ ويتم تعديلها بحيث يصبح بالإمكان الطعن بقرار استئناف قرار الإحالة القطعية لدى محكمة التمييز.

English Abstract

This study deals with the issue of guaranteeing entitlement in judicial sales, and we found that the Jordanian legislator did not regulate the provisions of the guarantee of entitlement in judicial sales and leave its rule to the general rules that contain the provisions of this guarantee, unlike the Egyptian legislator, which regulated its provisions in Article 416 of the Law of Pleadings Civil and commercial.

The study concludes that both texts in the Jordanian and Egyptian legislations under study have authorized the owner to auction rights before the receivable and the seller has the right to request a refund of the price paid, and compensation for damages caused by the fact of entitlement.

However, when comparing the provisions of the Jordanian Civil Code with the text of article 416 of the Egyptian Civil and Commercial Procedure Code, the study found that the Jordanian legislator preferred the Egyptian legislator to determine the person obligated to refund the price and compensation to the buyer.

The most important recommendations were that the Jordanian legislator should specify in the enforcement law a period of time to register the decision of the categorical transfer, as did the Egyptian legislator in the Egyptian Code of Procedure, so that it is an argument against others.

And that the Jordanian legislator should review Article 20 of the Implementation Law and amend it so that it would be possible to appeal against the decision to appeal the decision of the peremptory transfer in the Court of Cassation.
