Abstract EN

The main objective of this study it's to determine the limits of criminal case in front of criminal trail, because of the significant of this matter in the criminal procedures as long as it's considered one of the litigation guarantees which approved by the procedural laws to ensure the readiness of the accused person to defend himself, specially the problem may raised because of trail restrict up to the limits of the criminal case, and if there is may authorized this court to add facts instead of those which transmitted decision of referral.

For that this study will search the conceptual, conditions and determine the scope of the limits of criminal case, and then it will show the most important remedies to the Iraqi penal provisions.
