Arabic Abstract
جاءت هذه الدراسة بهدف الوقوف على ماهية التوقيف، و الذي يعتبر من الإجراءات الاستثنائية و الخطيرة، حيث تم اعتماد المنهج الوصفي التحليلي، و المنهج المقارن من خلال المقارنة بين القانون العراقي و الأردني مع الإشارة إلى القوانين الأخرى حيثما تطلبت ضرورات البحث ذلك.
وقد خلصت الدراسة إلى مجموعة من النتائج كان من أبرزها، أن التوقيف يجب أن يكون محاطا بقيود عدة و ضمانات للموقوف، إضافة إلى أن التوقيف لا يعد من العقوبات السالبة للحرية على الرغم من أنه إجراء يسلب حرية المشتكى عليه.
و قد أوصت الدراسة أن يحذو المشرع العراقي حذو المشرع الأردني فيما يخص بدائل التوقيف التي أقرها المشرع الأردني في التعديل الأخير لقانون أصول المحاكمات الجزائية لما لهذه البدائل من دور في صون حرية الفرد من التعدي عليها.
English Abstract
The purpose of this study is to identify the nature of the detention, which is considered an exceptional and serious measure.
The analytical descriptive approach and the comparative method were adopted by comparing the Iraqi and Jordanian law with reference to other laws where the research necessities required it.
The study concluded with a series of results, the most prominent of which is that the detention must be surrounded by several restrictions and guarantees for the detainee.
Moreover, the arrest is not considered a deprivation of liberty, although it is a procedure that takes away the complainant's freedom.
The study recommended that the Iraqi legislator follow the example of the Jordanian legislator regarding the alternatives of detention approved by the Jordanian legislator in the recent amendment to the Code of Criminal Procedure because these alternatives have a role in safeguarding the freedom of the individual from infringing
