English Abstract

The NU Security Council has started to play a more effective role intervention in non-International armed conflicts which multiplied after this year to reduce violence in various parts of the world, bearing in mind that the proliferation of these conflicts may threaten International peace and security.

International intervention is justified by humanitarian motives, to maintain and restore peace and security, and to stop violence between the parties involved in those conflicts.

The role played by the Security's Council in maintaining peace and security has evolved by the use of International traditional mechanisms to modern mechanisms under its prerogatives delegated to it in accordance with the Chapters of the Charter ; it can pressure on the armed parties to comply effectively with the rules of the Chapter VI of the Charter.

And relying on the Chapter VIII of the Charter, the Security Council's as well as the General Assembly's Resolutions have reiterated that local organizations have the priority over the Security Council for addressing conflicts.

The transfer of responsibility to local Organizations might be executed by Security Council's Resolution or by request from another State, under confidence of the effectiveness of local level to enable such organizations to execute a key role in intervention by the ways of preventive diplomatic arrangements, in accordance with the Charter.

As such, the Security Council has employed various modern International peaceful mechanisms ; among these, the General Secretary has appointed a Special NU envoy into the conflicts scenes to investigate and make a report to the NU Security Council on the appropriate intervention methods to take on.

The Security Council requires modernizing the international mechanisms to face the difficulties emerging from the continuity of armed conflicts, such as the 1998 Rome Agreement which established the International Criminal Court and the Special Criminal Courts under the principle that any criminals have to be tried.
