In studies of international criminal justice that preceded the international criminal permanent court, it was concluded that no international criminal body can stand away from politics, so the Rome Statute drafters tried to strengthen the institutional status of the Permanent Court and its legitimacy and effectiveness in the international system by taking advantage of previous experiences, particularly avoiding political considerations in the public prosecution strategies to carry out their duties in a high legal and judicial professionalism degree.

Unfortunately, through the fact, referrals and cases brought before the ICC after more than a decimal of practice, It seems clear that the resistance against political factors at any moment is difficult, but political elements are considered by some as a real test to the credibility of the court as a whole and to the public prosecution in particular
