Abstract EN

The aimed to take the limitation of action in the lapse of hudud offenses and the aim of its legislation.

Also the researoh concentrate on the evidence’s importants and its rules through witness as an important and strong reference in the resource of guidelines and different means of evidence .

the research investigated if the limitation of action had a lony time passed on it , is it to be taker in the execution of rules !according to its Importants in the Islamic legislation and Gog’s right which can not be diposed or forbade if it reached to judge ! Firstly the study showed .

the meaning of limitation of action and the aim of its legislation.

Secondly it showed the different views of Islamic Scholars in the limitation of action in hudud offenese and its rule and time in the execution .

Thirdly the study took the meaning if witness and its rule, important and sharing in the hudud offenses .

Fourthly the study showed the Islamic scholars’ views on the recusal of limitation of action in the hudud offenses .

lastly the study clear ified the effect of recusal of limitation of actionin the hudud offenses according to the four prominent doctrine, the Sudanese Criminal law and the law of Evidence (1994).

Lastly the research aims to the concept of the certificate in the punishment within concentrating on the Ideas of the law one the results and recommendations such as :- 1- hudud offence should be done for Good 2- the punishment of the charger should not be for bidden to make him fear all the tim.
