Abstract EN

The electronic crimes are a blatant aggression, on the cultural, scientific, technical, and economic structures, it affects the security and stability of the state, which must be confronted and reduced.

The best way of this confrontation lies in the legislative confrontation by broadening the scope of criminalization to cover all forms of crimes, including its initiation.

In fact, we have seen that the Jordanian legislator has dealt with punishing the initiation of all felonies, but punishing the initiation of misdemeanors has dealt with it within general rule, that no penalty may be set for committing the initiation of misdemeanors unless a provision is provided for, and that as long as the case is like that, then the penalty imposed for committing the initiation of misdemeanors in the digital environment should be conditional upon providing a provision for convicting the same.

However, the current study concluded that the Jordanian legislator did not convict committing the initiation of misdemeanors stated upon in the Electronic Crimes Law althousn it convicted the same in some electronic crimes in other laws.

However, we wished it to amend the legislations related to the crimes of the digital environment and in particular, the Electronic Crimes Law by which it would adopt the penalty for committing the initiation of misdemeanors included therein out of their danger from one part and to enhance the legal protection for individuals as well as the saved and circulated outputs through the electronic and digital information systems in addition to the programs and databases from the other part.
