Abstract EN

The research aims to determine the criteria between what is considered to be right and what is considered to be an infringement of journalists' rights when they express their opinions under both Jordanian and the UAE laws.

Moreover, this paper identifies the due compensation, its types and its rules.

The research problem is about determining the balance between what constitutions and laws guarantee as freedom of opinion and expression on the one hand, not prejudicing to the interests of individuals, whether physical or moral on the other hand.

Press tort liability in both countries is based on the idea of civil wrong rather than mere harm, unlike general civil liability.

Moreover, compensation in kind is not plausible as it is difficult to be applied.

Hence, monetary compensation or the performance of a specific command is the optimum compensation for the harmed person or his family with granting the harmed person the right to command correction or courter reply for what was published about him / her.
