Abstract EN

Through empirical research, this paper examines one of the recognized principals of fair trial which is the innocence of human being in the inference stage before the law enforcement officers.

Drawing on multidisciplinary sources, including the work of language scholars, psychologists, framing theorists, and legal professionals, this paper explains that there are human rights that emerged from the principal “innocence” which has been recognized by most of the legal systems in the globe.

This principal needs to be exposed to show the most important rights the defendant enjoys in the inference stage when the defendant appears before the law enforcement officer; these rights are available and practical to represent a presumption and sincerity on the performed investigation done by law enforcement officers, and the testimony delivered by the defendant.

It also creates a reflection on the principle of selfconviction of the Criminal Judge, so that will have an impact on the legal status of the defendants.

This research paper concludes the most prominent human rights to be granted to the defendant before the law enforcement officers, and the extent impact between human rights at the stage of inference and the legal status of the defendant under the provisions of the Jordanian law.
