Abstract EN

Where a subject’s labor contract was terminated because of economic or technical reasons, the Jordanian legislator has provided for this by putting in place both subjective and objective measures to make such termination lawful.

Furthermore, the Minister of Labour has been given the authority to approve such termination of the contract.

However, the law has made it clear that the Minister’s decision on approval of termination can be challenged by the competent court of appeal.

In this paper the authors have tried to establish the effectiveness of the judicial review on terminating the labor contract as well as examining the extent to which this judicial review mechanism complies with the constitutional litigation rights, such as the right to access two steps litigation as well as guarantee of defense right.
