موقف القانون الدولي من المستوطنات الإسرائيلية على الأراضي الفلسطينية

Following Palestine’s acceptance as a “non-member observer State” to the United Nations in November 2012, Israel announced the construction of new settlements.

The construction of Israeli settlements is considered one of the main obstacles for peace negotiations between Israel and Palestine, and the Israeli-Palestinian conflict as a whole.

The questions on the legality of Israeli settlements in the West Bank in particular involve historical, religious and political positions of the conflicting parties that seem barely reconcilable.

Faced with these obstacles, such occupational actions in constructing the settlements on the Palestinian territories are manifestly incompatible with the principles of international law and the United Nations resolutions in this regard, also, the occupational procedures have had the worst impact on the Palestinian people since the beginning of the Israeli occupation in Palestine, until now, where the impacts are clear in all areas of political, demographic, economical, social, environmental, and educational.

This article argues that international law could serve as an ‘objective framework’ to clarify some of the disputed issues related to the Israeli settlements in the occupied territories.
